Picking the Right Place for Your Date

Saturday, March 29th, 2008

By Ron Zvagelsky There are a number of reasons I stress the importance of the place you choose for your date. First, you don’t want to take your date to a place they are not interested in. You must both choose a place that you mutually agree on. If your date suggests that the two of you go to a place that you’re not comfortable with, you should not be afraid to let them know this. If you go to a place that makes you uncomfortable, it can damage the date. It will also show that you have poor communication skills, because you failed to make it clear that you didn’t want to go there. To pick the best place for a date, you must first understand the interests of both you and your partner. For example, if either you or your partner hates sports, does it make sense to buy tickets to a sports event? If you or your partner hate being in large crowds, does it make sense to attend a crowded party? It is critical that you choose a date that perfectly matches the interest of both you and your partner. If the two of you cannot come to a consensus on where you want to go, this may be a sign that the two of you are not compatible with each other. The reason I say this is because if you both have similar interests, it should be easy for you to choose a suitable location for your date. An art gallery is a great place for those who are intellectual or have artistic interests. Another good place for these types of people is the library or bookstore. Many couples choose a dinner and a movie. If you do this, pick a movie that the both of you are equally interested in. The same goes for food. A dinner and a movie is a classic form of dating, and it is a great way for the two of you to get to know each other better. You may not want to go to an expensive restaurant on your first date, unless this is something both of you agree on. Another good place for couples is a nice park or garden. You can sit and talk about various topics while enjoying the company of each other. A classic place for intellectuals is the museum. This is a quiet place where the two of you can talk about the various exhibitions that are being presented it. Those who enjoy being in large crowds may want to go to concerts, sporting events, or even clubs. If you both like to shopping, you can spend a day going to various stores. Data Protection: New Interpretation of the Data Protection Act

Friday, March 28th, 2008

By Rosanna Cooper A restrictive interpretation of the Data Protection Act 1998 (”the Act”) will limit subject access requests1. Businesses may welcome the Court of Appeal’s judgment from Durant v FSA [2003], as it might make their obligations under the Act easier to fulfill. The case of Michael John Durant v Financial Services Authority [2003] EWCA Civ 1746 - Court of Appeal focuses on the right of an individual to access his or her personal data held by an organisation. After a dispute with his bank, which involved the bank successfully applying an exemption which denied him the right of access to his data, Mr Durant complained to the Financial Services Authority (”FSA”). Although the FSA investigated his complaint, it did not reveal detailed information about its investigation to Mr Durant. The FSA made available documents in computerised format but refused him access to manual files, claiming that the information sought was neither “personal” nor part of a “relevant filing system”. Mr Durant appealed. The Court of Appeal held that:- The purpose of the subject access provision is “…to enable [an individual] to check whether the data controller’s processing… unlawfully infringes his privacy and, if so, to take such steps as the Act provides (i.e. blocking or rectification)… It is not an automatic key to any information, readily accessible or not of matters in which he may be named or involved.” Records that make reference to an individual are not necessarily “personal data”; The records must be relevant or proximate to the individual (i.e. significantly biographical or of which the individual was the focus of attention). In deciding on a case-by-case basis whether information falls within the Act, two factors are relevant: “…Whether the information is biographical in a significant sense, that is, going beyond the recording of the putative data subject’s involvement in a matter or event that has no personal connotations… …information should have the the putative data subject as its focus rather than some other person with whom he may have been involved or some transaction event…In short, it is information that affects his privacy, whether in his personal or family life, business of professional capacity”; It is not sufficient that the records just relate to something in which the individual was involved; The records must contain “information that affects [the individual's] privacy, whether in his personal or family life, business or professional capacity” - “It is likely in most cases that only information that names or directly refers to [a data subject] will qualify and “not all information retrieved from a computer search against an individual’s name or unique identifier is personal data within the Act”; The definition of “relevant filing system” in relation to manual filing systems (i.e. paper-based) are those which are clearly structured, in a manner akin to computerised records, and within which the data must be readily accessible for reasons of practicality, easily identifying the fact that it contains personal data relating to the individual; There must be clear warning to litigants that the Act: “…is not an automatic key to any information, readily accessible or not, of matters of matters in which he may be named or involved. Nor is to assist him…to obtain discovery of documents that may assist him in litigation or complaints against third parties.” The Court ruled that Mr Durant should not be given the documents requested as, “mere mention of the data subject in a document held by a data controller does not necessarily amount to his personal data”. Mr Durant is awaiting permission to challenge the Court of Appeal’s ruling in the House of Lords. Diet Food Stinks!

Wednesday, March 26th, 2008

By Dr. Jamie Fettig One big thing that can keep you from eating healthy is the idea of the food. People often think it sucks and doesnt taste good. That is the best thing of not dieting, the food tastes great. And since eating healthy is a non-diet the food also tastes great, often better than junk food. Have you ever had a strawberry that was so good it was almost orgasmic? People get caught up in comparing the old food they used to eat to the new food they are now eating. Don’t do this. Do not get caught up in trying to find something that tastes like your old favorite thing. Here is a little secret, the natural healthy food will not taste the same. It will taste better, if you let it. Let me explain what I mean with a story. My friend was eating an apple, and after a bite or two, she put the apple down and was going to throw it away. It was one of the worst apples she had ever eaten, she said. Dont ask me why, but I wanted to taste the worst apple ever. I took a bite, and it tasted pretty good to me. And then I had a thought. If I ate the apple expecting an apple taste, it was pretty bad. In fact, horrible. But when I tasted the apple for the taste it had, without comparing it to anything else, it was fine. In fact, the apple was pretty good. My friend, who just a moment ago was going to throw the apple out, tasted it again. When she didnt compare it to what she thought an apple should taste like, she thought it was pretty good as well. If you try to compare the new food you are eating to things youve eaten in the past, it will not be the same. It is not the same. But if you actually taste the new food you are eating for the food it is, you will find it is just as good, if not better, than the food you used to eat. Fresh and pure food always tastes better than toxic food, if you taste the food for what it is without comparing it to what you used to eat. Find your new favorite foods from healthy selections and the food you eat will taste great. Junk food is NOT actually easier and more convenient. I also share this and more with you in my free e-course that this article is a part of. Go to http://www.HealthyEatingDiet.com to get the full e-course. Is Every Man Really Cut Out To Be A Father

Monday, March 17th, 2008

By Gregg Hall When a man first learns he will be a father, a bit of pride wells up inside of him. This is the child of his making. He celebrates, for hope has found a new life. Every man must indeed be proud of his children. The child is a reflection of the father and the mother. The prospective father talks with excitement. His range of emotions is beyond measure. Men respond in different ways when they first learn their child will be born. They are surprised by the initial news. Becoming a father is an exciting event. When the response to fatherhood is shared, the excitement is contagious. Everyone rejoices with the announcement a child will be born. We know the world will never be the same again. A new little person is coming to join the human race. A father awaits the birth of his child with love as he contemplates the happy event. He accepts the responsibility of providing for his family as he works hard, anticipating the special day when his child will be born. In a moment of concern, he vows he will protect his family forever. The human response to fatherhood is one of protection for his wife and the child. Men fulfill duty and responsibility with different levels of concern and performance. Some men respond with the greatest concern while others remain aloof, unconcerned. A man with genuine concern is sensitive to every need at this delicate time. Each man chooses the way he carries the weight of responsibility for his own family. Even if he does not respond to family needs, every man feels responsibility for his children. He must be part of the birthing process, when the baby comes. Love is the measure that drives him when he has reached his lowest peak. Fatherhood is a reflection, a reminder of this duty. A man remembers his responsibility. Some men show sensitivity, and respond with positive actions for mother and child. When they learn of their fatherhood, they form a new commitment and they keep their promises. They are helpful with every need. Their life is changed because they now have a unique opportunity to serve another person as the father of their child. This bond is sacred. It is built on love and trust. Every father is called to these deep responsibilities. It is elementary that a man would care for his family. From the beginning of time, men have protected women and children from danger. Knights fought to preserve the life of the land. Fathers know they must protect their family. Accepting the role of fatherhood shows growth for it takes a mature man to be the father for their child. Gregg Hall is an author living in Navarre Beach, Florida. Nokia Planning To Turn Fantasy Into Reality

Saturday, March 15th, 2008

By [http://ezinearticles.com/?expert=Adam_Jaylin]Adam Jaylin With technology at your disposal nothing seems impossible and you might even sound a touch arrogant when you prophesise about the future. But recently mobile phone manufacturing giant Nokias top tech geek Tero Ojanpera said something that would seem improbable even for that lovable boy wizard called Harry! In his final keynote speech at the Nokia World Conference, Nokias chief technology officer made a sort of unofficial announcement that they are working on a mobile phone with a 100GB in-built memory and a lot more! He almost got carried away that when he announced that mobile phones will also have sensors that will give you weather updates and also guide you to the nearest bus stop in case of a shower!! I just wonder why anyone with such a handset will be looking for a bus!! But jokes apart the mobile phone market is one segment of electronic goods industry that has the potential of upstaging every other sub-category in this colossal industry. Despite the saturation level being reached in certain markets the mobile phone industry is going strong but it can reach the pinnacle only with technological advancements like what Ojanpera discussed in his address to the gathering of press reporters. How to Create an Effective Mortgage Direct Mail Campaign

Saturday, March 15th, 2008

By Oliver Maldonado Direct mail is the most effective and cost effective way to generate new mortgage business there is. Marketing as we know it has changed dramatically over the past few years. Homeowners have more resources than ever before, they can research almost any type of mortgage, company, or product online, and within seconds have the information they wanted. This has taken a significant percentage away from conventional forms of marketing. New spamming laws and telemarketing Do Not Call lists (Which over 58 percent of homeowners in the United States are registered on) dont leave a lot of ways to directly market to homeowners. With these factors in mind direct mail can be the best most cost effective way to reach new mortgage prospects. With direct mail youd have the potential to reach 100 percent of all homeowners in the United States. What if I told you Ive discovered a direct mail piece that generates an amazing 20 to 30 percent response? I send 75 pieces per week, at a cost of $35 (Including Postage). Of those Ill typically get 15 to 20 incoming calls. These will generate about 8 to 10 new mini applications per week which is all I need to reach my current closing goals of 5 to 6 closings per month. Creating the Mailer It should be obvious that in order to generate this kind of response that the direct mail piece must be an aggressive one. There are two components to my direct mail campaign, both packaged in a single envelope. The first is a letter that simple says, Please call me at your earliest convenience at (Phone number) regarding the enclosed document, followed by my name and signature. The second piece is what gets the homeowners attention, and is also what helps generate a huge response, a copy of their Deed of Trust. The Deed of Trust is perceived by most homeowners to be a very private financial document. In reality, of course, it is available through public records at any county clerks office. However, most consumers are not aware of this, so curiosity plays a large role in the effectiveness of this mailer. When they read the letter they realize that someone has a copy of their Deed of Trust, people immediately question who it could be from and what it is regarding, especially because there is no wording regarding solicitation of any kind in the accompanying letter. In fact, I created this mail campaign based on a similar tactic sent to my home, which intrigued me in exactly this way. You may receive calls from homeowners who are confused or surprised at the prospect of someone (You) having access to their legal documents. Some callers may even be angry or upset by the mailer. Use those calls to explain your position and take the opportunity to inform them about your services. Homeowners in debt may be concerned that this is another letter from their bank, or a warning about foreclosure. Once you reassure them that youre there to help, you can almost always get an application over the phone. Youd be amazed by the results. In addition to the county clerks office, you can also get the Deeds of Trust from the title company you work with. Not all title companies the resources to get deeds, but call around and you should be able to find one. If not dont worry, my website www.MortgageDirectMail.com contains information on how to get copies of deeds. Eliciting Response The contents themselves are not the only reason for this positive response. There are other aspects to why this direct mail campaign is so successful. The envelope and the way the recipients name and address appears also has a huge effect. There is a reason the national response average is less than one percent. People hate junk mail and when they spot it, they tend to disregard the mail before even opening it. Your first goal is to get the homeowner to open the envelope. Sounds simple, but many people dont think about this, and that is the reason for a lower response rate. Here are some suggestions for creating an appealing direct mail piece: Step OneDevelop a compelling direct mail piece. Use the one described above, or invent one of your own that will induce a high response. Remember, you dont necessarily need to mention your services in the mailer. The method that has worked well for me is to simply provide my phone number, and request that they call regarding the document enclosed. Step TwoDetermine which homeowners youd like to target. Do you mostly work with Conventional, Jumbo, or FHA loans? Do you want to specialize in a particular niche? Next, compile a list of homeowners on which to focus your marketing efforts. You probably already have a similar list in your database. If not, call some of your contacts and title companies, many will produce a complimentary list for you. Or you may want to purchase leads from a reputable company. Step ThreeNow that youve got your address list, you must hand address each mail piece you will be sending. This is going to take some time, but the results will be worth it. If you really dont have the time and you dont have an assistant, you can recruit your children, hire a temporary assistant, or enlist your friends help. Taking the time to hand address the envelopes is one of the most important steps, increasing the response rate substantially. This is what gets them to open the mail piece, most junk mail is not hand addressed. Additionally, I have found the effect to be even greater when I dont use a company envelope of put a return address. You may choose to simply put your name and address, but leave your company name and logo off. Many people are turned off by unsolicited mail of any kind, and this is a way to circumvent that. Step FourUse regular postage, not bulk rate. Deliver the marketing pieces to your post office on Saturday morning to ensure your mail will reach homeowners on Monday and Tuesday, with a few arriving on Wednesday. Believe it or not most people who respond to direct mail respond on the first three days of the week. When mailers arrive on Thursday or Friday, consumers tend to put off calling until after the weekend, and then, in most cases, forget to follow up.Thats it! Four simple steps to a successful mortgage direct mail campaign you can even do from home. By engaging the consumer and piquing their curiosity you will increase your direct mail response rate dramatically.
